Setting up a drug-screening program in agreement with USCG regulations
Pre-employment Testing
All licensed/documented personnel and unlicensed/undocumented personnel who perform Safety Sensitive duties must be tested with negative result prior to beginning work
Random Testing
50% annual testing requirement
Everyone must be eligible for selection each time
The person choosing the date and time of testing cannot be subject to the regulations and therefore not in compliance with the USCG.
Serious Marine Incident Testing
Casualty resulting in:
  1. Death
  2. Injury needing medical treatment beyond first aid
  3. Damage in excess of $100,000
  4. Actual/constructive loss of vessel
  5. Injury which renders individual unfit to perform routine duties
  6. 10.000 gallon or more oil spill
  7. Hazmat spill of a reportable quantity

Must test all personals directly involved.
Must be tested by the Marine Employer.
Individuals must provide sample.

Reasonable Cause Testing
Who has the authority to require testing?
  1. Marine Employer
  2. Any Law Enforcement Officer
Employee Assistance Program
Employer shall provide and Employee Assistance Program for all employees.  Land, Sea & Air recommends TRI-STATE REACH (631) 218-9102.

Must include education and training on drug abuse.

  • Display Drug Policy

Supervisors must receive 60 minutes of training in Supervisory Reason to Suspect Training.

Management Information System Report
Required of all marine employers
Submit to: Commandant (G-MOA)

Due by March 15 of each year
This report is a summary of all drug screening activity done the previous program year.

Records
  • Maintain records of chemical tests with positive results for 5 years
  • Maintain records of chemical tests with negative results for 1 year
  • Maintain record of all employees that have received EAP training
  • Maintain copy of MIS reports
Consortium
Land, Sea & Air's Coast Guard Consortium has met all of the requirements set forth in the regulations.  We are using certified laboratories for all our chemical testing needs and all Coast Guard drug screens are NIDA 5 drug screens.

The marine employer is ultimately responsible for compliance with the USCG regulations, and all MIS reports due each year.
