Pre-Employment, Applicant Search for Safety Sensitive Position

As a new service, Land, Sea & Air is offering to perform complete pre-employment searches for the required two year period for a safety sensitive employee.  All documents that you need to complete can be retrieved off of our web site.  The fee is $25.00 for each employee search.  Land, Sea & Air will provide all paper work to you to prove that a "Good Faith" search was performed as required by DOT regulations.

If you shoud decide to rehabilitate a new employee with a history of a positive or adulterated test result, there may be an additional fee if Land, Sea & Air assists you in the rehabilitation process.

Please complete the following steps:
  1. Have the new employee complete the "Employee Release for LSA to Obtain Drug and Alcohol Testing History from Previous Employers for the past two years on behalf of New Employer," Form A.
  2. Form B, "Request for Drug and Alcohol Testing History," must be completed for EACH safety sensitive position for the past 2 years the applicant listed on Form A.
  3. Your company must sign the "Company Release for LSA to Perform Pre-employment Search," Form C, to allow LSA to act on your behalf for the pre-employment searches for a particular individual.
  4. Form D, "Employee Alcohol and Drug Statement," must be completed and signed by the new employee and your company representative.
  5. Fax all forms to us at (631) 661-6358.
Remember you can employ this individual in a safety sensitive position for thirty days before you get the results of the search.   If the searches reveal that the employee had a positive or adulterated drug or alcohol test and he/she never completed rehabilitation required by the DOT, you must release him from employment in the safety sensitive position, without any penalty to you.   If he/she did complete the required rehabilitation, he/she can remain in the safety sensitive position.  If he/she completed the initial part of the rehabilitation process, he/she can continue working as long has the rehabilitation is continued to completion as required by the DOT.  We can monitor this continued rehabilitation process.
If all the releases are sent to all the companies that the applicant worked for in a safety sensitive position and you receive no responses, the applicant can continue working past the thirty days because LSA can provide proof for you that a "good faith" effort was made by your company (as required by the DOT regulations).
Companies are required to forward drug testing records once they receive a release from the employee.  If a company does not forward this information they will be out of compliance and subject to fines.
REMEMBER:  Above and beyond the pre-employment search, you are required to ask the applicant if he/she had a positive result or refusal to test (adulterated or substituted specimen) on a pre-employment drug or alcohol test.
